They help us

AAM (Associated Asset Management, based in Tempe, AZ)

We outsource specific operations to AAM, a homeowner association management company, to handle on our behalf.  These include items such as assessment billing, vehicle registration, “common area” landscape requests, architectural submissions, code of conduct issues and Board and committee requests.


BlueStar Resort & Golf/BlueStar Landscaping (based in Scottsdale, AZ)

We outsource specific operations to two different BlueStar entities to handle on our behalf.  This includes areas such as our Kiva & Mita Clubs including Café Solaz, Mita Marketplace, Alvea Spa, Fitness facilities, Lifestyle Events & Activities, meeting room reservations, Golf & V’s.   BlueStar Landscaping is accountable to manage our beautiful grounds within Trilogy.


Curtis S. Ekmark, Esq., Ekmark Pecor Law, PLLC

We have selected Ekmark Pecor Law to provide us with general counsel on legal matters. The firm practices community association law exclusively. They have a client base consisting of some of the best associations, many of whom have been clients for more than ten years. They are trusted partners who are accessible, reliable, and experienced in solving problems. Their experience allows them to be efficient, both in terms of time and cost, in handling matters on our behalf, regardless of complexity.


VMC

VMC is the Vistancia Maintenance Corporation, created to carry out obligations set forth in the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Vistancia recorded on July 9, 2003, in Maricopa County, amended and restated in 2018. 

  • This document is also known as the Vistancia Declaration. It is the governing document for the entire Vistancia community. The Vistancia Declaration provides for the formation of “Village Associations” in which Owners of lots and parcels within the Village are mandatory members.
  • Trilogy at Vistancia is one such Village Association. Blackstone, North Pointe, Vistancia HOA and the Commercial Core are also members. The Village Associations are mandatory members of the VMC. 
  • The purpose of VMC’s formation includes the management and maintenance of the Vistancia Community Common Areas (not Trilogy owned common areas) that benefit the entire Vistancia Community. As such, all Village Association and other Parcel owners within Vistancia are assessed a portion of the costs to do so.

           Where does the money go to that we pay to VMC?  

  • VMC owns the property along Lone Mountain, El Mirage, Vistancia, Ridgeline and Jomax Roads.  They also maintain the Discovery Trail.  All the landscape maintenance, irrigation repairs, common area repairs, water, electricity, insurance, water feature maintenance, pest control and reserve funding are done through these assessments that all the “Villages” pay.  
  • Currently, VMC is under Declarant Control.  This means that the Developer holds the majority stake still.  Under Arizona Law, they are not required to hold Board Meetings.   Once it is turned over to the homeowners (like our community did June 2023), there will be regular Board of Director meetings.  The Board will be made up of the Employees of Land Resources (the Developer) and the Board Presidents from each of the Villages.

Even the rules help us

For HOAs, implementing universal rules and expectations is part of what helps a community thrive.  To structure these, every association has three types of governing documents:


CC&Rs (Covenants, Conditions & Restrictions) - Contain the community’s use restrictions, obligations and assessments.  Think of them as the “what” of the HOA.  

  • This document is kept on file with the state of Arizona and requires approval by the board and a vote by 2/3 of the membership to make any changes.
  • Note:  For Trilogy at Vistancia, we have separate CC&Rs for the Golf Course/Vs


Bylaws: Establishes “how” the community operates.  

  • Like CC&Rs, this document requires approval by the board and a vote by 2/3 of the membership to amend.


Association Rules: This document serves as a catch-all for the things that aren’t covered in the CC&Rs or Bylaws.  Often, these are the rules that might need revising over time due to changes in the community.

  • This document can be changed by an HOA board vote, with review by the members of the community.  


Other important governing documents to be aware of include Design Guidelines and the expected Code of Conduct  (pages 6-7 in this document) for our community.
